When a life insurance claim is filed the claimant is required to provide proof of the insured’s death. It is standard language in life insurance policies, ‘We will pay the face amount of the policy upon receipt of proof of the insured’s death.’ The proof referred to is usually an original death certificate. And for the most part that is the only requirement needed for the claim proceeds to be paid (unless the policy is in the two-year contestability period).

We get concerned when we hear widespread complaints that a life insurer has a culture and practice of delaying legitimate life insurance claims — and then we see the evidence that supports it.

Does the proposed insured have any chronic illness or condition which requires periodic medical care or may require future surgery?

Most people do not understand this question. They answer “No” and Globe denies their claim. A Chronic Condition is any condition of the body or mind that needs: medication, observation, therapy or that occurs more than one time. This includes:

High blood pressure, High cholesterol, COPD, Recurring pneumonia, Back problems, Sciatica, Diabetes, Auto-Immune problems, Lupus, Arthritis, Depression, Sleep problems,….

We’ve seen Globe deny claims for all of these conditions. It doesn’t matter how severe or how frequent the person was seeing a doctor. Globe is looking for reasons to deny claims that come in during the first 2 years a policy is in effect and they use this question, more than any other, to deny claims.

You must answer the application question “Yes” if you take any medications, visit a doctor for anything other than a check-up, see a therapist, have a hereditary condition, have treatment for any condition more than once per 10 years.

An insurer may take action to be sure they follow proper payment procedures – like verify the identity of a claimant — but the main point is that the insurer takes action.

A life insurance policy, among other things, is a legal contract. Globe Life’s contract simply says ‘prove the insured is dead and we will pay the claim’. There are no other stipulations or requisites in the contract for a claim to be paid. So then, any other request from Globe Life, before they will pay a claim, seems to be an unnecessary delay and an unfair claim practice. Some of the delay tactics we have been alerted to include:

· Requiring proof of who paid a policy’s premiums. This is an unfair claim practice and not a legitimate reason to delay claim payment. There is no law that states one person cannot pay the premium of another person’s insurance policy.

· Requiring a published notice of death (obituary). Again, this is an unfair claim practice. A beneficiary must submit an original Death Certificate, but a claim cannot be delayed because an obituary notice is not provided.

· Failing to respond to a claimant in a reasonable amount of time. There is nothing more frustrating than an insurer simply not responding. Even with vague state laws about claim processing time, Globe appears to be going well beyond reasonable time limits.

· And one of the most suspicious habits of Globe Life’s claims department is a consistent assertion that they have not received requested documents by mail or fax. We have had complaints of the same documents being sent 2 and 3 times before Globe Life acknowledged receiving them. If we only heard about this once or twice it would not be a concern, but when we hear the same complaint repeatedly over many years, we know we have a pattern.
