Will it help if I call the insurance company and make a complaint?
Probably not. The reason we say this is because there are standard processes that life insurance companies follow when they receive complaints. A big part of the complaint process includes the need for documentation and proof. It’s not enough to give a written account of how you were harmed and how angry you are. This type of complaint usually goes nowhere.
Life insurers are looking for specific things that can prove you have a legitimate complaint, but they’re not likely to tell you what they’re looking for. Unless you have experience with the life insurance complaint process your complaint isn’t likely to get your claim paid or your premium refunded.
Can the Department of Insurance help me?
It’s best to think of a state’s Department of Insurance as an organization that has limited oversight and even more limited enforcement powers. A department of insurance oversees things like; the filing of new policies an insurer wants to sell in a State, proper form filings, an insurer’s financial requirements, licensing of agents, and other activities that have a lot to do with collecting fees.
What a Department of Insurance doesn’t do is make life insurance claim decisions. They won’t say whether a claim should or should not be paid. So, don’t waste your time complaining or letting them investigate. They don’t have the authority to do anything about denied life insurance claims or claims under a contestable investigation.
A Department of Insurance also can’t force a life insurer to refund your premiums. They might fine an agent for bad practices, and they might terminate an agent’s license, but that doesn’t get you a refund. That doesn’t put money back in your pocket.
Unfortunately, most department’s won’t tell consumers these facts up-front. A lot of time can be wasted with nothing to show for it.

I lost my 2 sons on March 27th. Joshua has a $25,000 policy with Guardian. He named his brother Jeffery the beneficiary. The company that Joshua was employed by offered this insurance as a benefit and named me as the administrator. Jeffery passed away the same day as his brother. Joshua passed before Jeffery passed; however, pending death certificates have them passing away at the same time. My boys died in their father’s arms; Joshua’s children were present too. All have stated that Jeffery before passing away asked his father to get his brother to Urgent Care. His last words before he passed. 911 was called twice once at 4:34 am and again at 4:44 am. They EMT showed up at the home at 4:45 am and pronounced them deceased. This is the time they put on the birth certificates! This Life Insurance Company has been fighting with me to collect the insurance because of the time of death! Although this company has spoken with Joshua’s employer, the Investigators in this case, the Police in this case, and by reading the Police Report once can come to the conclusion that Joshua passed before Jeffery therefore the policy should be paid to Jeffery’s estate. I am also the Administrator of Jeffery’s estate as he was a single man without children. This policy was taken out to help with all expenses should Joshua pass away. This has caused a tremendous hardship on this family. As grandparents we are struggling with taking care of the children, living expenses, and cost of burying 2 sons. DO NOT PURCHASE A POLICY THROUGH THIS COMPANY.

Received a letter from Guardian, dated early April, stating that my Whole Life policy premium would need to be paid IN FULL this year because there were insufficient dividends earned this year to cover my premium. Then received that premium notice, dated last week, for the full $1,000+ premium. What?! No dividend at all?
Just called Guardian and eventually learned that there were dividends earned on my policy and that the dividend was less than $99 short of my annual premium. Had I not called I would have paid 10X more than I should! OOPSY!
Wonder what Guardian is gonna do with all the extra cash that they get from people who didn’t/don’t bother to follow-up?

Guardian Life is holding my monthly disability check. This is the 3rd time. Every time I get a new case worker assigned, they hold the check, they never notify me beforehand, I have to call and try to find my new case worker. I usually get paid on the 6th. This time I called on the 6th to ask and a rep told me that the case worker had it on hold until proper paperwork was turned in. What paperwork? I had already given a doctors status update to my previous case worker in Sept and gotten an email back thanking me for it last month. This is constant willful negligence and harassment. Now I have to choose between groceries for my kids or my prescriptions.
